I believe one of the greatest changes to the banking industry has been the emergence of e-banking.

Growing up in the 1980’s, my parents ran their own business. Back then, very few people owned a personal computer, which often meant recording finances by hand or making unexpected visits to the bank. These visits would often take hours of my parent’s time and also meant a lot of free cookies, as I waited in the bank lobby. And banking after hours? That simply didn’t exist.
Fast forward to today, I too am a small business owner. But unlike my parents, with the emergence of e-banking I’m not spending countless hours in bank lobbies, but rather, spending time growing my business. Whether I’m on the go to my next photoshoot or in the comfort of my home, I can virtually manage all of my finances 24/7. Within a few short minutes, I can pay my bills, track my expenses, balance my checking, and transfer money to anywhere in the world. And even when I’m away from my computer, I can receive alerts on my phone so that I always have funds available when I need them most.

While I don’t think e-banking will ever replace the wonderful individuals I bank with on a daily basis, today’s technology allows me to carry my banker in my back pocket (with room to spare for a cookie or two). I can only imagine how the next 25 years in banking will evolve.

TRADE PROMOTION CONTEST: NO PURCHASE REQUIRED. A PURCHASE WILL NOT AFFECT YOUR CHANCES OF WINNING.

THE PROMOTION: The Promotion consists of four separate essay contests (each an “Essay Contest”) in which entrants (“Entrants”) can submit an essay (“Essay Answer”) in response to one of four Essay Questions posted by Sponsor (as defined below) on its Website page in accordance with the Essay Contest Periods set forth below. One Potential Winner will be selected by a panel of judges for each of the four Essay Contests. Winning Essay Answers and Winners’ biographical information may be used in promotional activities at Sponsor’s discretion and in accordance with these Rules, including being posted on Facebook.

ELIGIBILITY: The BNC National Bank Anniversary Essay Contest (the “Promotion”) is only open to legal residents of North Dakota who are at least 18 years of age at the time of entry. Void where prohibited and subject to all laws. Employees, officers and directors of Sponsor, and its parent, affiliate and subsidiary companies, and members of their immediate families (children, parents, siblings and spouses of each) and persons residing in the same household (whether or not related) are not eligible to participate. By entering, Entrants agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding regarding all matters pertaining to the Promotion.

PROMOTION PERIOD: Promotion begins at 12:00 a.m. CT on November 25, 2015, and ends at 11:59 p.m. CT on September 21, 2016 (the “Promotion Period”), with individual Essay Contest Periods as follows:

  • Essay Contest #1: 12:00 a.m. CT November 25, 2015 –11:59 p.m. CT December 9, 2015;
  • Essay Contest #2: 12:00 a.m. CT February 25, 2016–11:59 p.m. CT March 9, 2016;
  • Essay Contest #3: 12:00 a.m. CT May 25, 2016 –11:59 p.m. CT June 9, 2016; and
  • Essay Contest # 4: 12:00 a.m. CT August 25, 2016 –11:59 p.m. CT September 9, 2016.

Sponsor’s computer will be the official time-keeping device for the Promotion.
Limit one Entry and Essay Answer per person per Essay Contest; each Entrant may submit a total of four Entries/Essay Answers over the course of the Promotion.

How to Enter: Find the currently-open question for the current Essay Contest (“Essay Question”) either on Sponsor’s website at www.bncbank.com (“Website”) or on the display at any one of Sponsor’s North Dakota branch locations. The Promotion may be entered in one of three ways for each Essay Contest:

  1. Online: Visit the Website contest page (www.bncbankblog.com/essay/) and follow the directions to complete the online entry form and to submit your Essay Answer. Online entries must be submitted by 11:59 p.m. CT on the last day of the currently-open Essay Contest Period, as provided above.
  2. By Mail: Obtain a paper entry form either at one of Sponsor’s North Dakota branch locations or download and print it from our Website. Complete the entry form and Essay Answer as instructed and submit together by mail to:

    You are responsible for ensuring that you have affixed sufficient postage. Mailed entries must be postmarked by the last day of the currently-open Essay Contest Period, as provided above.
  3. Branch Location: Obtain a paper entry form either at one of Sponsor’s North Dakota branch locations or download and print it from our Website. Complete the entry form and Essay Answer as instructed and submit together at one of Sponsor’s North Dakota branch locations by giving it to a personal banker who will date stamp it and forward to Marketing. Branch-submitted entries must be submitted to a North Dakota branch location during open hours on or before the last day of the currently-open Essay Contest Period, as provided above. Branch location hours may be found on the Website.

For each method of entry, you will be required to completely and accurately provide your name, email address, physical address, telephone number and zip code and to agree to these Official Rules and all other terms and conditions specified on the Website. Along with your entry information, review the Essay Question and prepare an original essay responding to the question. Essay Answers must be 250 words or less. Essays Answer must be comply with the word-limit and other directions provided on the Website and in these Rules to be valid. If Essay Answer exceeds the word limit it will be disqualified.

Once an Entry is submitted it cannot be changed in any way and becomes the sole property of the Sponsor pursuant to the Ownership of Intellectual Property Rights section of these Rules. Neither it nor related correspondence or inquiries will be acknowledged or returned.

The Essay Answer must not contain material or information that (1) violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement; (2) is inappropriate, indecent, vulgar, obscene, hateful, tortious, defamatory, slanderous or libelous, promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; (3) defames, misrepresents or contains disparaging remarks about other people, companies or entities; or (4) is political or commercial solicitation.

Multiple Entrants are not permitted to share the same email address. In the event of a dispute regarding the identity of an Entrant, the authorized account holder of the email address used to register will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Any attempt by any an Entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Entrant’s Entries and that Entrant will be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. .

Entries which do not comply with any terms or conditions of the Official Rules, in Sponsor’s sole discretion, will be disqualified. Any Entry which Sponsor, in its sole opinion, deems to be inappropriate for publication for any reason will not be considered and the Entrant submitting that Entry will be entirely disqualified.

CONTEST JUDGING: Essay Answers will be judged anonymously by a panel of 5 BNC Bank employees (“Judges”) based on the following criteria with a 1 to 10 point score awarded for each criterion: creativity/originality (40%); composition (30%); represents history/spirit of BNC Bank (30%). For each Essay Contest, the Entrant who submitted the Essay Answer with the highest score is the Potential Winner of that Essay Contest. In case of a tie, the tied entry with the highest score in creativity/originality will advance. If the tie continues, the tied entries will be re-judged by a new employee judge panel using the above criteria.
The Potential Winner for each Essay Contest will be notified by the e-mail or phone provided in the Entry or by on or around the following dates:

  • Essay Contest #1: December 28, 2015;
  • Essay Contest #2: March 25, 2016;
  • Essay Contest #3: June 27, 2016 and
  • Essay Contest # 4: September 21, 2016.

WINNERS: Each Entrant is eligible to win only one Prize. Each Potential Winner will be required to complete, sign, and return an Affidavit of Eligibility, a Liability Release and, where lawful, a Publicity Release within ten days of the receipt of the Prize Notification and documents. If documents are not timely returned, or if a notification is returned as non-deliverable or a potential winner cannot be contacted after two attempts, or if a Potential Winner is found to be ineligible or not in compliance with these Official Rules, that Potential Winner will be disqualified and the prize forfeited, and an alternate selected, based on the process outlined above, if Sponsor determines that circumstances reasonably permit.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. A POTENTIAL WINNER IS NOT A WINNER OF ANY PRIZE UNTIL THEIR ELIGIBILITY AND COMPLIANCE WITH THESE OFFICIAL RULES HAVE BEEN VERIFIED AND POTENTIAL WINNER HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.

PRIZES: One prize will be awarded for each of the four Essay Contests. Each Winner (one for each of the four Essay Contests) will receive Two Thousand Five Hundred Dollars ($2,500) (“Prize”). Total prize value is $12,500.

If a Winner cannot accept a Prize, it will be forfeited in its entirety and awarded to an alternate Winner, if circumstances permit. Taxes on all Prizes are solely the responsibility of the Prize Winner. Potential Winners must provide Sponsor with his/her social security number for tax purposes. In no event will Sponsor award more prizes than are listed in these Official Rules.

CONSENT AND RELEASE: Entrants consent to use of his/her Essay Answer he/she submitted, as well as his/her name, likeness, biographical information and voice in promotion and advertising, worldwide and without compensation or right of review or approval where not prohibited. Further, Entrants agree: (a) to release, discharge, indemnify and hold harmless Sponsor, and its respective affiliate, subsidiary and related companies, retailers, advertising and promotion agencies, and all of their respective employees, officers and directors, representatives and agents, and Promotion administrators and judges (collectively and individually the “Releasees”), harmless from and against any and all liability, claims, action, or proceedings, losses, injuries and damages of any kind (whether due to negligence or otherwise), including personal injury, death, and/or property damage, and/or breach or failure of any representation or warranty, and/or infringement, dilution, or misappropriation of any third party’s intellectual property rights (including, but not limited to, copyright, patent, trade secret, trademark/trade name, and/or infringement of rights of publicity or privacy, defamation, slander, or libel, or portrayal in a false light) arising, in whole or in part, directly or indirectly, from Entrant’s Essay Answer, Sponsor’s use of Entrant’s Essay Answer, Entrant’s participation in any aspect of the Promotion or any Promotion-related activity, or Entrant’s acceptance, possession, use or misuse of any prize; and to Sponsor’s (or those acting pursuant to Sponsor’s authority) use of Entrant’s name, biographical information, voice and/or likeness, related prize information, Essay Answer, (each or all of which Sponsor may change, modify or edit, or use alone, together or with other works, and/or use in a distorted, illusory or composite form) for advertising, trade, commercial and promotional purposes.

Entrants also agree not to release any publicity or other materials on their own or through someone else regarding any aspect of their participation, including winning a prize, in the Promotion without the prior written consent of the Sponsor, which Sponsor may withhold in its sole discretion.

OWNERSHIP OF INTELLECTUAL PROPERTY RIGHT IN ENTRIES: Each Essay Answer (the “Intellectual Property”) will be deemed a Work Made For Hire under the Copyright laws of the United States in favor of Sponsor, but if it cannot be so deemed or to the extent the work includes intellectual property rights other than copyright, then each Entrant irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to the Intellectual Property, including but not limited to all copyright, trade secrets, patents, trademarks and other rights therein, in the United States and worldwide, for valuable consideration, the receipt and sufficiency of which is hereby acknowledged.

Upon request of Sponsor at any time, each Winner shall execute and deliver such instrument of assignment as Sponsor may deem reasonably necessary to evidence the ownership of the right, title and interest that a Winner may have in and to the Intellectual Property, and of the rights transferred to Sponsor hereunder, and to record it with the U.S. Copyright Office or its equivalent in any foreign country, or with any other office for the protection of intellectual property.

Entrants expressly waive (i) any “moral rights” and “droit moral” rights they may have in the Intellectual Property, and (ii) any rights they may have in it pursuant to the Visual Artist Rights Act or, if applicable, California Civil Code Section 987, Massachusetts Gen. Laws Ch. 231, § 85S (the Massachusetts Art Preservation Act), or other similar laws anywhere in the world.

REPRESENTATIONS, WARRANTIES AND INDEMNITIES: Each Entrant represents and warrants that they (a) are 18 years or older and have the full right, power, and authority to enter into this Agreement; (b) can fully and lawfully perform their obligations hereunder and grant the rights set forth in this Agreement; (c) the Essay Answer he/she submits and the exercise of Sponsor’s rights in and to the Essay Answer hereunder, do not and will not violate, misappropriate, or infringe any third party’s intellectual property rights, including but not limited to trademark rights, copyrights, moral rights and privacy or publicity rights; (d) possess all rights necessary for the Sponsor’s reproduction, distribution, transmission, public performance, public display, and other exploitation of the Essay Answer as permitted hereunder; (e) that all factual statements and information submitted for the Promotion are accurate, truthful and not misleading; and (f) that the Essay Answer which they submit is his/her sole creation and has not been copied in whole or in part from any other creative work or other source.

LIMITS OF LIABILITY: Releasees are not responsible for typographical errors in these Official Rules or Promotion-related advertising, or promotional materials, lost, late, damaged, stolen, separated, incomplete, illegible, misdirected or non-delivered entries; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections, accessibility or traffic congestion, failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Releasees are not responsible for injury or damage to participants’ or any other person’s computer related to or resulting from participating in the Promotion or downloading or copying materials from or use of Website. If, for any reason, the Promotion is not capable of running as planned, including by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failure or any other causes which, in the sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, or force majeure, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend all or any part of the Promotion without further notice. Sponsor has the right, but not the obligation, to award the prize from among all valid and eligible Entries received up to the time of such event, in any manner deemed fair and equitable by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Promotion or Website, may be acting in violation of the terms of the Website or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage the Website or undermine the legitimate operation of the Promotion is unlawful and subject to legal action by Sponsor or its agents.

The information you disclose when you register for the Promotion will be subject to the Privacy Policy set forth on the Website.

IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS’ ACCESS TO AND USE OF THE WEBSITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

ARBITRATION/CHOICE OF LAW: Any disputes that may arise related to or in connection with this Promotion, shall be governed in all respects by the laws of the State of Minnesota without regard to the conflicts of laws principles of any jurisdiction. Except where prohibited, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, including but not limited to any prize awarded or the determination of the winners, shall be resolved individually, without resort to any form of class action or other litigation, and exclusively by final and binding arbitration before a single arbitrator pursuant to the Rules of the American Arbitration Association, then effective, and held in Minneapolis, Minnesota; (b) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (c) judgment upon such arbitration award may be entered in any court having jurisdiction; and (d) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion but in no event attorneys’ fees,
